Rubbish Removal Chelsea Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Chelsea provides rubbish removal, waste collection and related services to domestic and commercial customers. By booking a collection or using any of our services, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, company or organisation booking or receiving the service from Rubbish Removal Chelsea.

Services means any rubbish removal, waste collection, loading, transportation, clearance or disposal services provided by us.

Booking means a confirmed request by the Customer for Services on an agreed date and time window.

Waste means any rubbish, refuse, debris, junk or other materials to be collected, transported or disposed of as part of the Services.

We, us, our means Rubbish Removal Chelsea.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services for residential and commercial premises, including but not limited to household waste, bulky items, garden waste, office clearance waste and general non-hazardous rubbish.

2.2 Our services typically include the loading of waste from the Customer's premises, transportation and disposal or recycling at a licensed waste facility or transfer station.

2.3 We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, dangerous, illegal, contaminated, excessively heavy, incorrectly described, or not safely accessible.

2.4 We do not provide specialist removal services for asbestos, clinical waste, chemicals, liquids, gas bottles, pressurised containers or any other hazardous or controlled waste unless expressly agreed in writing in advance and subject to additional terms and charges.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form or other booking method we may make available from time to time.

3.2 At the time of booking, you must provide accurate and complete information, including the collection address, access details, the type and approximate volume or weight of waste, and any relevant access or parking restrictions.

3.3 Based on the information provided, we will give you an estimated price and an agreed date and time window for collection. This estimate is subject to inspection of the waste and site on arrival.

3.4 Your booking is confirmed only when we have acknowledged it and, where required, received any deposit or advance payment. We may refuse a booking at our sole discretion.

3.5 The Customer must ensure that a responsible adult is present at the premises at the agreed time to provide access, confirm the waste to be removed and, where applicable, sign any required documentation.

4. Customer Obligations

4.1 You must ensure safe and reasonable access to the waste at the collection address. This includes ensuring that driveways, entrances, stairways, lifts and internal routes are clear and safe for our staff to use.

4.2 You must ensure that the waste presented for collection matches the description you provided at the time of booking. If there is any significant variation in type, volume or weight, additional charges may apply or the collection may be refused.

4.3 You are responsible for obtaining any necessary permissions or permits for access, parking or loading at the collection site, unless we have explicitly agreed in writing to arrange such permits.

4.4 You agree not to include any hazardous, flammable, explosive or otherwise dangerous substances in the waste unless expressly agreed in writing in advance.

4.5 You must not place sharp objects, glass, metal or other potentially injurious items in locations where they pose a risk to our staff. Such items should be securely contained or flagged to our crew.

5. Pricing and Quotations

5.1 Prices for our services are usually based on the volume and type of waste, the labour required, access conditions and disposal costs.

5.2 Any price quoted in advance is an estimate only and is subject to adjustment after our crew has inspected the waste on site. If the actual waste differs from the description provided at booking, we may revise the price accordingly.

5.3 We will notify you of any price increase before commencing the work. If you do not accept the revised price, you may cancel the booking at that time, but you may be liable for a call-out or cancellation charge if we have attended the site.

5.4 All prices are quoted in pounds sterling and, unless clearly stated otherwise, are inclusive of standard rubbish removal, transportation and lawful disposal charges. Additional services such as extensive dismantling, packing or heavy lifting beyond normal expectations may incur further charges.

6. Payments

6.1 Payment for the Services is due on completion of the collection unless otherwise agreed in writing. We may require full or partial payment in advance for certain bookings.

6.2 We accept common methods of payment such as cash, major debit and credit cards, or bank transfer. We do not accept cheques unless expressly agreed in advance.

6.3 Where we have agreed to provide services to a business customer on account, payment is due within the agreed payment period stated on our invoice. If no period is specified, payment is due within 14 days of the invoice date.

6.4 If you fail to make payment when due, we reserve the right to charge interest on the overdue amount at the statutory rate permitted under applicable UK law, as well as any reasonable costs incurred in recovering the debt.

6.5 Ownership of any waste materials passes to us only after full payment has been received and the waste has been loaded onto our vehicle. Until that point, we reserve the right not to remove the waste.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by giving us notice by telephone or email.

7.2 If you cancel more than 24 hours before the agreed collection time window, no cancellation fee will normally apply, unless we have incurred specific costs or ordered special equipment on your behalf.

7.3 If you cancel within 24 hours of the agreed collection time, we reserve the right to charge a reasonable cancellation fee to cover our administration, scheduling and any travel or staffing costs already incurred.

7.4 If our crew attends the site at the agreed time and is unable to gain access, or the waste is not available for collection due to your act or omission, this will be treated as a late cancellation and a call-out or wasted journey fee may be charged.

7.5 We will use reasonable efforts to accommodate requests to change the collection time or date, but such changes are subject to availability and may result in rescheduling to the next available slot.

8. Service Performance and Delays

8.1 We will use reasonable care and skill in performing the Services and will make reasonable efforts to attend the site within the agreed time window.

8.2 Time is not of the essence in relation to our attendance or completion of the Services. Factors such as traffic, weather, access issues or operational constraints may lead to delays.

8.3 If we are delayed or unable to attend as scheduled, we will aim to contact you as soon as reasonably practicable to agree an alternative time or date. We will not be liable for any indirect loss or consequential costs arising from such delay.

9. Waste Handling and Compliance

9.1 We are committed to providing responsible rubbish removal and waste collection services in accordance with applicable UK waste management legislation and local authority requirements.

9.2 We will transport and dispose of waste at licensed waste transfer stations, recycling centres or disposal facilities, in compliance with our duty of care obligations.

9.3 We may segregate, sort or bulk up waste at our discretion to facilitate recycling and compliance with waste regulations and environmental standards.

9.4 You confirm that you are the owner of the waste or have the authority of the owner to arrange its removal and disposal. You agree to indemnify us against any claims arising from a lack of such authority.

9.5 You must not knowingly request us to collect waste that you believe or suspect to be hazardous, controlled or illegal without first informing us in writing. Failure to do so may result in additional charges, refusal of service and possible reporting to the relevant authorities.

10. Liability and Insurance

10.1 We will exercise reasonable care when carrying out the Services, but we shall not be liable for pre-existing damage or for any wear and tear, defect or fault at the premises that is not caused by our negligence.

10.2 Our liability for any loss or damage arising out of or in connection with the Services shall, to the fullest extent permissible by law, be limited to the total price paid or payable for the specific service giving rise to the claim.

10.3 We shall not be liable for any indirect, special or consequential loss, including but not limited to loss of profit, loss of business, loss of opportunity, or any costs, expenses or damages arising from delays or non-performance outside our reasonable control.

10.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be excluded or limited under UK law.

10.5 You are responsible for ensuring that any fragile, valuable or delicate items at the premises are protected or removed from the area of operation before we commence work. We accept no liability for damage to such items unless caused by our proven negligence.

11. Customer Conduct and Safety

11.1 You agree to treat our staff with respect and not to subject them to abusive, threatening or unsafe behaviour. We may withdraw our Services and leave the site immediately if our staff consider the environment to be unsafe or abusive.

11.2 You must not instruct our staff to perform tasks that fall outside the agreed scope of Services or that may place them at risk, such as working at unsafe heights, entering confined spaces or lifting items beyond safe manual handling limits.

12. Data Protection and Privacy

12.1 We will collect and process personal information about you, such as your contact details and service history, for the purposes of managing your booking, providing the Services and handling enquiries or complaints.

12.2 We will handle your personal data in accordance with applicable UK data protection laws. We will not sell your personal data to third parties and will only share it where necessary for the performance of the contract, legal compliance or the protection of our legitimate interests.

13. Complaints and Dispute Resolution

13.1 If you are dissatisfied with any aspect of the Services, you should notify us as soon as possible, providing full details of the issue.

13.2 We will investigate complaints in a fair and timely manner and, where appropriate, may offer a remedy such as a partial refund, re-performance of the Services or another reasonable solution.

13.3 If a dispute arises that cannot be resolved directly between us, both parties agree to consider reasonable forms of alternative dispute resolution before commencing formal legal proceedings.

14. Variations to Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our business practices or the nature of our waste collection and rubbish removal services.

14.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or explicitly agreed in writing between us.

15. Force Majeure

15.1 We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to extreme weather, strikes, lockouts, accidents, breakdowns, traffic disruption, fire, flood, or actions of government or regulatory bodies.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of our rubbish removal and waste collection services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services, including any non-contractual disputes or claims.

By confirming a booking with Rubbish Removal Chelsea or using our Services, you acknowledge that you have read, understood and agree to these Terms and Conditions.
